VOTE RED! 🇺🇸🇺🇸🇺🇸

MAINE’S VERIFICATION WORKAROUND—AND WHAT ONE-PARTY CONTROL HAS PRODUCED Mainers are repeatedly told that our employment and election systems are secure. But when you examine the laws and legislative record, a troubling pattern emerges: Maine’s political establishment avoids openly creating “exemptions.” Instead, it defeats stronger verification requirements, expands eligibility through broader legislation and leaves the public to discover the consequences afterward. THE EMPLOYMENT WORKAROUND Every Maine employer must complete federal I‑9 paperwork, but Maine generally does not require employers to use E‑Verify—the federal system that compares a new employee’s information with Social Security and Homeland Security records. In 2019, LD 1077 would have required Maine employers to use E‑Verify. Shenna Bellows, then a Democratic state senator and committee chair, supported the majority “Ought Not to Pass” recommendation and made the Senate motion that helped kill the bill. It never reached Governor Janet Mills, so she did not veto it. But throughout the Mills years, Maine’s one-party Democratic government failed to enact another statewide E‑Verify requirement—even for sensitive positions involving children, hospital and hospice patients, inmates, firearms or public authority. Now five Cumberland County corrections officers have been detained by ICE in less than two years. Maine has also employed noncitizens in law enforcement, transportation, healthcare, childcare and other sensitive fields. Many noncitizens are here legally and perform essential work honorably. That is not the issue. The issue is that criminal-background checks, professional licenses and Maine driver’s licenses do not continuously verify immigration or employment status. The workaround is simple: don’t pass an exemption—just defeat the verification requirement and leave the weaker system in place. THE VOTING WORKAROUND Maine law ordinarily says voters must establish a fixed and principal home in the community where they vote. But another provision creates a remarkable exception. In 2009, while Matt Dunlap was Maine’s Secretary of State, LD 1169 added language allowing a United States citizen living abroad who has never lived anywhere in the United States to register and vote in the Maine community where a parent is a qualified voter. That means someone born and raised entirely in Europe may legally become a Maine voter without ever residing in Maine—or anywhere in America—provided that person is a U.S. citizen and has a qualifying parent. The statutory language does not expressly restrict that eligibility to federal elections. This provision was placed inside a large omnibus election-law bill formally sponsored by Representative Pamela Trinward. It passed the Democratic-controlled Legislature without a recorded House or Senate roll-call vote and was signed by Democratic Governor John Baldacci. Again, the workaround is accomplished without openly saying, “Maine residency no longer matters.” Instead, lawmakers create an exception inside a much larger bill, pass it without recording how individual legislators voted and leave the provision in law for years. THIS IS THE PATTERN Under one-party control, stronger verification is defeated while eligibility is quietly expanded. Then, when Mainers ask questions, we are told the systems are secure because those same systems have not documented a problem. This is not an attack on lawful immigrants, overseas American citizens or honest workers. It is a demand for transparency, verification and accountability. A background check is not an immigration check. A driver’s license is not proof of citizenship. And someone who has never lived in Maine should not be treated as a Maine resident without Mainers being fully informed and their elected legislators being placed on the record. That is the total workaround—and Mainers deserve to know who created it, who preserved it and who continues to benefit politically from keeping the public in the dark.
